Terms of Use
These Terms of Use (“Terms”) govern your use of the Oil Tracker app (the “App”) and this website. By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Who we are
The App is provided by Bearing LLC, an Alabama limited liability company, which offers Oil Tracker under the Bearing Analytics name (“we,” “us,” or “our”). Contact: support@bearinganalyticsllc.com.
2. Apple’s Standard EULA
The App is licensed to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”), available at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms add to the Standard EULA. If there is a conflict between them, the Standard EULA controls to the extent required by Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for it.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, for your personal, non-commercial use. You may not copy, resell, redistribute, or reverse engineer the App or its content, or use automated means to extract data from it, except as permitted by law.
4. Subscriptions
Some features require a paid auto-renewing subscription. The subscription title, length, and price are shown in the App before you purchase.
- Payment will be charged to your Apple ID account at confirmation of purchase.
- The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price.
- You can manage and cancel your subscriptions by going to your account settings on the App Store (Settings > your name > Subscriptions) after purchase.
- If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription.
- Refunds are handled by Apple under its policies.
5. Informational and educational use only
The App and all of its content, including market data and charts, are provided for informational and educational purposes only. Nothing in the App is financial, investment, legal, tax, or trading advice, or a recommendation or offer to buy or sell any security, commodity, or other instrument. The content is general in nature and does not consider your individual circumstances. You are solely responsible for your own decisions. Consult a qualified professional before making financial decisions.
6. Third-party data
Market and fundamental data are obtained from third-party sources. Data may be delayed, incomplete, revised, or inaccurate, and may be unavailable at times. We do not guarantee the accuracy, timeliness, or completeness of any data, and third-party providers have no liability to you.
7. Acceptable use
You agree not to misuse the App, interfere with its operation, attempt to gain unauthorized access to our systems, or use the App in violation of any law.
8. Intellectual property
The App, its design, and its original content are owned by us or our licensors and are protected by intellectual property laws. Except for the license above, no rights are granted to you.
9. No warranty
THE APP AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TRADING LOSSES, OR LOSS OF DATA, ARISING FROM YOUR USE OF OR RELIANCE ON THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
11. Termination
We may suspend or end your access to the App if you violate these Terms. You may stop using the App at any time by deleting it and canceling any subscription through your Apple ID settings.
12. Governing law
These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law rules. Any dispute will be brought in the courts located in Morgan County, Alabama, unless applicable law requires otherwise.
13. Changes
We may update these Terms from time to time. We will post the updated Terms on this page and update the effective date. Continued use of the App after changes take effect means you accept the updated Terms.
